תנאים כלליים ומדיניות פרטיות לביצוע אבחון גנטי ולשימוש בו
1. התנאים
א. האבחון והפענוח מבוצעים על ידי חברת GenePlanet, Personal Genetics, d.o.o.(להלן: "GP"), כמו כן, המידע האישי והרגיש מבוקר על ידי GP. בדיקת המעבדה נעשית על ידי חברת Genesort Ltd. (להלן: " Genesort ") או מי מטעמה או על ידי GP (להלן: "החברה" ו/או לפי הענין "אנו", "אותנו" ו"שלנו"). אנא קרא/י בעיון את התנאים הכלליים לביצוע אבחון גנטי ולשימוש בו שלהלן (להלן: "התנאים"), כיוון שהם ישפכו אור על התהליך ויאפשרו לך להתוודע אל המידע והתוצאות והצפויות מהתהליך.
ב. אנו שומרים לעצמנו את הזכות לשנות תנאים אלה בכל עת.
ג. התנאים נוסחו בהתאם להוראות החוק של רפובליקת סלובניה וישראל. לבתי המשפט בישראל נתונה סמכות השיפוט הבלעדית על כל תביעה או סכסוך שינבעו מהתנאים או בקשר להם, למעט נושאים הקשורים לפיענוח התוצאה של הבדיקה הגנטית אשר נתונים לסמכות השיפוט הבלעדית של סלובניה.
2. מובהר בזאת כי חברתMyBio הנה גוף מתווך המטפל בכל התהליך הלוגיסטי. חברת Genesort או GP תבצע את האנאליזה המעבדתית ומפיקה את התוצאות הגנטיות ו- GP מבצעת את עיבוד המידע הגנטי.
3. תהליך ההזמנה
א. קיבלת ערכה לצורך נטילת הדגימה הביולוגית שלך הכוללת הוראות להפקת הדגימה, ובמקביל, יש להכנס ולהרשם בפורטל מאובטח של GP ולהרשם באתר כמשתמש חדש. במסגרת הפורטל יש להכניס מידע אישי הכולל : מין, תאריך לידה, משקל וגובה , לאשר את קריאת התנאים הכלליים באשר לאבחון ה-DNA מידע זה חיוני לצורך עריכת האבחון. יש לזכור את שם המשתמש וסיסמת הכניסה לפורטל שכן אליו ישלחו ממצאי האבחון עם הפקתם. מובהר כי הנתונים האישיים אשר הנך מכניס ניתנים על ידך מרצונך החופשי. עוד מובהר כי אינך חייב למסור מידע זה אם אין ברצונך לעשות כן. בכל זמן עתידי תוכל לפנות אלינו ולבקש כי מידע אישי שהכנסת יימחק מהמערכת שלנו.
ב. חשוב למלא באופן מוקפד את כל המידע הדרוש כיוון שאחרת לא נוכל לקבל את הדגימה שלך.
4. יש להחזיר לזכיין המקומי בישראל, חברתMyBio את דגימת הרוק.
א. לאחר השלמת תהליך האבחון הגנטי של ה- DNA שלך, נשתדל לשלוח לך את תוצאות הבדיקה הגנטית (הדו"ח המסכם) תוך ארבעים ימים מהמועד בו הגיעה לידינו הדגימה הביולוגית שלך.
ב. מידע (עם התוצאות הגנטיות), תוכן גרפי, טקסט, תמונות, סימני מסחר, שמות מסחריים וסמלים מסחריים (להלן "החומרים") מוגנים בזכויות יוצרים ובדיני קניין רוחני אחרים. עם קבלת הסכמתך לתנאי השימוש, אנו נעניק לך, לתקופת זמן מוגבלת, רישיון לא-בלעדי לצרכים אישיים. צרכים אישיים משמעותם לקריאה, לצפייה ו/או להדפסה של העתק זמין אחד של החומרים, כל עוד אין בכך משום פגיעה בזכויות היוצרים, סימני המסחר וההודעות הקנייניות האחרות. כל שימוש אחר בתכני הניתוח הגנטי, כגון העתקה, שינוי, הפצה, העברה, פרסום מחדש או שימוש בתוכן אסורים.
ג. במקרה של שינוי בכתובת למשלוח תוצאות הבדיקה, עליך להודיע במועד המתאים ל- GP באמצעות .MyBio אם הדבר לא ייעשה בזמן, אזי הדו"ח המסכם יישלח לכתובת האלקטרונית שצויינה בעת ההזמנה ותיחשב כאילו התקבלה.
ד. עם קבלת הדו"ח המסכם, האחריות לשמירת סודיותו ולהגנה מפני עיון על ידי מי שאינו מורשה לכך, חלה עליך.
ה. מובהר כי לדעת משרד הבריאות הישראלי עדיין אין ביסוס רפואי מספק לבדיקות הללו.
5. גישה לשרת האינטרנט
א. אנו עושים כמיטב יכולתנו לדאוג ששרת האינטרנט יהיה בתפקוד מלא באופן רציף וקבוע. יחד עם זאת, עקב המהות של העולם הדיגיטלי ובעיקר של שרותי האינטרנט, אין אנו יכולים להבטיח שהשרת יהיה נקי מתקלות, הפרעות או שגיאות וכי הגישה לשרת עלולה להתעכב (אם עקב בעיה אצלנו או מסיבה חיצונית אחרת) באופן זמני ו/או ללא הודעה מוקדמת. אנו לא נהיה אחראים לכל איבוד או פגיעה הנובעת מבעיה בזמינות השרת (אם כתוצאה מתהליכי העיבוד האינטרנטיים או מכל סיבה אחרת).
ב. אנו עשויים להגביל, להשעות או לבטל את הגישה שלך לשרת באם אנו נאמין כי הפרת את "התנאים הכללים" המובאים במסמך זה בכל עת. ההשעיה או הגבלת השימוש בשרת תהיה ללא כל קשר לדעה מוקדמת אודותיך אלא אך ורק בהקשר להפרת התנאים המובאים בזאת.
ג. באחריותך להבטיח כי שום גורם בלתי מוסמך או מאושר לא יקבל גישה לשרת ולחשבונך בשרת זה. הנך האחראי/ת הבלעדי/ת לכל פעילות המתבצעת בחשבונך בין אם הנה מאושרת על ידך ובאם ללא אישורך המפורש וזאת עד לקבלת הודעה מטעמך אודות השימוש הבלתי מורשה וחסימת החשבון שלך על ידינו. אם תהיה לנו הסיבה להאמין כי אכן בוצעה חדירה לא מורשית לחשבונך, או שימוש לא הולם בחשבונך אנו עשויים לשנות חלק או את כל סיסמאות הכניסה שלך וליידע אותך על כך.
ד. אנו שומרים לעצמנו את הזכות לעכב או לבטל לאלתר את הגישה שלך לשרת באם תהיה לנו הסיבה להאמין שהסיסמא שלך נוצלה לרעה.
ה. אנו עשויים להציג באתר שלנו קישורים לאתרי אינטרנט נוספים המופעלים על ידי גורמי צד שלישי, קישורים אלו מובאים כשירות ולנוחיותך בלבד. אתרים אלו שאליהם הנך עשוי/ה להכנס אינם קשורים אלינו ואיננו מהווים נציגים שלהם. עם כניסתך לכל אתר חיצוני אחר, הנך מבין/ה כי זהו אתר בלתי קשור אלינו וכי אין לנו כל שליטה על התכן או הזמינות או הפרטיות של אותו האתר.
6. ייעוץ טלפוני והיוועצות רפואית
לגבי כל שאלה ביחס לדו"ח המסכם ו/לגבי תוצאות האבחון, ביכולתך להיוועץ במומחה מטעם GP באמצעות מספר הטלפון 059 25-11-11 או באמצעות דוא"ל info@geneplanet.com. בנוסף, ניתן להתייעץ גם עם הזכיין המקומי במייל info@mybio.co.il או בטלפון 03-9221500
7. זכויות ביטול והחזר כספי
א. הזכות לביטול הסכם ההתקשרות ביננו עומדת בפניך בהתאם לתנאי הביטול המובאים בזאת עם קבלת ערכת האבחון, באפשרותך לבטל את ההזמנה תוך 7 ימי עסקים. עליך להחזיר על חשבונך את ערכת האבחון אלינו ללא פתיחתה וללא שבוצע בה כל שימוש, על הערכה להיות שלמה, ללא סימני פתיחה ובמצב המאפשר את מכירתה מחדש. אנו נבצע החזר עבור עלות האבחון תוך ניכוי דמי המשלוח.
ב. באם הספקת לפתוח את ערכת האבחון ואף סיפקת את דגימת הרוק במבחנה, אולם הדגימה עדיין לא עובדה במעבדה הגנטית, עדיין ניתן לבטל את ההזמנה תוך ניכוי עלויות התפעול ועלות ערכת האבחון.
ג. חשוב לנו להבטיח את שביעות רצונך מתהליך האבחון הגנטי. במקרה שאינך מרוצה מהמוצר או מהשירותים שקיבלת מאתנו, ניתן ליצור עמנו קשר באמצעות דואר אלקטרוני בכתובת info@mybio.co.il.
ד. מלבד זכות הביטול שלך במקרה של טענה מוצדקת המבוססת על פגם באיכות המוצר או השירות, אנו נהיה זכאים לספק לך מוצר או שירות חלופי (או לפי העניין, החלק הרלוונטי) ללא תשלום נוסף מצידך או על פי שיקול דעתנו הבלעדי, להחזיר לך את התשלום ששילמת (או את החלק יחסי, לפי העניין), אולם לא תהא לנו כל חבות נוספת כלפיך, אלא אם וככל שהגבלה זו אסורה לפי החוק.
ה. במידה ולא תקפידו על הנחיות לקיחת הדגימה וכתוצאה מכך הדגימה שתתקבל תהיה באיכות נמוכה אשר תמנע את הפקת הממצאים הנחוצים, אנו נחזור על תהליך המעבדה בשנית ונישא בעלויות הכרוכות בכך במידה ועדיין לא נצליח להפיק את המידע הנחוץ, נשלח לך מבחנה חדשה לאיסוף דגימת רוק נוספת וגם זאת על חשבוננו. במידה וגם הדגימה השניה תהיה באיכות נמוכה מדי ולא תעמוד ברמת האיכות הנדרשת תשלח אליך מבחנה שלישית. עלות תפעול המשלוח השלישי יחולו על הלקוח בלבד. עלות האבחון כוללת עד 4 נסיונות הפקת מידע מעבדתיים בלבד. במידה ונקבל 4 דגימות רוק באיכות ירודה שיעברו תהליכים מעבדתיים ללא הצלחה ההזמנה שלך והעלות ששולמה תשמש לכסוי כל העלויות הכרוכות בארבע הרצות המעבדה ולא ישולם לך החזר כספי.
8. התחייבויות והגבלת אחריות
א. ביצוע ההזמנה על ידך מהווה התחייבות כי:
o קיימת כשירות משפטית מצידך להתקשר בחוזה זה.
o גילך הוא 18 שנים לפחות;
ב. אם סיפקת דגימת רוק מטעם צד שלישי, אזי בידך ההרשאה מתאימה מאותו צד שלישי, והרשאה זו מצורפת יחד עם הצהרת ההסכמה לתנאים הכלליים המצורפת לדגימת הרוק. בנוסף, עליך לשלוח אלינו העתק של מסמך זיהוי המאשר את העובדה כי הנך מוסמך/ת לייצג את אותו הגורם עם חתימה ברורה של אותו הגורם.
חרף כל המאמצים מצדנו במטרה להבטיח כי כל מידע (לרבות התוצאות הדו"ח המסכם), המסופק על ידינו הוא נכון, איננו עושים כל מצג או התחייבות, במפורש או במשתמע, ביחס ללו"ח הזמנים, הדיוק ו/או השלמות של המידע האמור.
ג. אין להסתמך רק על התוכן או המידע המתקבל מתהליך האבחון הגנטי כבסיס לקבלת החלטות אישיות, תזונאיות ו/או רפואיות חשובות. עליך להיוועץ באיש מקצוע מתאים לשם ייעוץ ספציפי, המותאם לנסיבות האישיות שלך.
ד. קיימים מקרים נדירים בהם לא ניתן לקבל מידע גנטי חד משמעי בשל סיבות ביולוגיות או טכניות. משמעות הדבר היא כי המידע שהופק הוא באיכות כה נמוכה עד כי בלתי אפשרי לקבוע מהי התוצאה ב-100% ודאות. על מנת להבטיח איכות גבוהה, דיוק מדעי ונכונות של האבחון במקרים כאלה, אין בידינו לפרש את התוצאות וכתוצאה מכך, הדוח המסכם עשוי שלא לכלול מידע SNP כלשהו ותוצאות ניתוח ספציפיות. הדוח המסכם ייחשב כדו"ח שהושלם בהצלחה אם חסרים בו לכל היותר שני מאפיינים ספציפיים והאבחון לא ייערך שוב במקרה זה.
ה. אין אנו מתחייבים או מבטיחים כי האתר כמו גם השרת עליו האתר ממוקם יתאים לציוד הקצה בו הנך משתמש/ת וכי הנו חף מתקלות, כולל בין היתר וירוסים ומפגעי סייבר אחרים. בהתאם לכך אין אנו לוקחים אחריות לכל פגיעה שתתרחש ע"י וירוס מחשבים, באג, נסיון חבלה, חדירה בלתי מורשית, הפרעות, רמאות, כשל טכני, טעות, או מחיקה, פגם, עיכוב או כל ארוע אחר או התרחשות שהנה מעבר לשליטתנו אשר יפגעו או ישפיעו על ההתנהלות, האבטחה, ההגינות והיושרה כמו גם ההתנהלות הנאותה בהתיחס לכל היבט של האתר או הציוד שלך.
ו. אלא אם צוין במפורש אחרת בתנאים וההגבלות, כל הייצוגים, האחריות, התנאים וההגבלות, בין באופן מפורש ובין אם משתמעים ביחס לאתר זה או למידע הכלול בהם, אינם נכללים בזאת במידה המירבית המותרת עפ"י דין.
9. אחריות
א. הנך מסכים/ה לשפות ולפצות אותנו בגין כל הפסד או נזק שיגרם לנו בקשר עם שימושך באבחון הגנטי ו/או בדו"ח המסכם ו/או בקשר להפרת הוראות חוזה זה על ידך וכן בגין כל תביעה או הליך משפטי שיוגשו, או שיהא איום כי יוגשו, כלפינו על ידי כל צד שלישי, בקשר עם שימושך באבחון הגנטי תוך הפרת תנאי חוזה זה.
ב. הנך מאשר/ת לשפות ולפצות אותנו על כל אובדן או נזק שיגרם ע"י שימוש שלך באתר תוך הפרת התנאים וההגבלות כפי שהובאו לעיל ובגין כל תביעה או הליך משפטי שיוצג ע"י גורם צד שלישי שינבע בהקשר לשימוש שלך באתר תוך הפרת התנאים וההגבלות.
ג. בעת הזמנת הבדיקה, הנך מודע/ת להשפעות ולסיכונים הפוטנציאליים של תהליך אבחון גנטי והנך מסכימ/ה מתוך מודעות מלאה כיGP. ו/או genesort ו/או MYBIO ו/או מי מטעמן אינם נושאים באחריות כלשהי לתוצאות.
ד. המוצר ו/או השירות המסופקים אינם תחליף לאבחנה רפואית, טיפולים, המלצות רפואיות ו/או המלצות של גורמים ומוסדות בריאות רשמיים אחרים בנוגע לתרופות, תזונה, אורח חיים, שיטות טיפול או שירותים נלווים. המוצר ו/או השירות נועדו לצרכי מידע בלבד ולהפניית תשומת הלב לחשיבותה של מניעה לחיים ארוכים יותר ובריאים יותר.
ה. כל התחייבויותיך כלפינו בסעיף זה לעיל, ושאר התחייבויותיך במסמך זה, כפי שהינו כיום וכפי שישונה בעתיד, חלות יחד ולחוד כלפי genesort , GPוכן כלפיMyBio .
10. הוראות כלליות
א. אנו מבקשים ממך לקרוא בעיון את הוראות ההצהרה בנוגע לאבחון הגנטי, כיון שיהיה עליך לתת את הסכמתך עמם לפני משלוח המידע האישי שלך אלינו.
11. איסוף נתונים אישיים והשימוש בהם
א. כל מידע אישי שלך המופקד בידינו יטופל בהתאם לחוקי הגנת הפרטיות במדינת ישראל וסלובניה, לפי העניין. נתונה לך הזכות לגישה למידע האישי שלך המעובד על ידנו וביכולתך לבקש את שינויו, תיקונו, מחיקתו או הפיכתו לאנונימי. מובהר כי GP תהא אחראית כלפיך לבדה בגין כל נושא של שמירת הפרטיות לפי דיני סלובניה ו/או האיחוד האירופאי.
ב. דגימת רוק הנשלחת על ידך מכילה קוד גנטי, ונחשבת ע"פ החוק כמידע רפואי, אשר יטופל על ידנו כמידע אישי סודי ורגיש ביותר, במהלך כל תקופת יחסינו החוזיים. ניתוח הדגימה הכרחי בתהליך של ביצוע האבחון הגנטי. אנו מחויבים לשמירת סודיותם של נתונים כאמור ולשימוש בהם רק ככל שהדבר נחוץ לצורך הפקת הדו"ח המסכם . הנך מאשר/ת כי בהזמנת השירות ניתנת הסכמתך לכל תנאי הסכם זה וכן הסכמה מפורשת לעבד את המידע האישי הרגיש הנ"ל שלך. אם מוגשת על ידך דגימת רוק השייכת לאדם אחר, אנו נצטרך את אישורך כי האדם האחר נתן לנו את הסכמתו לעבד מידע אישי רגיש ביותר שכזה.
12. לידיעתך, MyBio אוספת נתונים עליך כלליים כגון: שם, טלפון, כתובת מגורים, מין, תאריך לידה, , כתובת אימייל, פרטי המוצר אותו רכשת, מחיר המוצר אותו רכשת וכיו"ב. אם בכל שלב הנך מעוניין למחוק נתונים אלו מרישומינו זו זכותך ואנא יידע אותנו בכך בפנייה למייל: Info@mybio.co.il .
13. גילוי נתונים אישיים
א. בהתאם לכללי הסודיות הקפדניים, אנו רשאים במידה הסבירה הנחוצה לביצוע המטרות המתוארות לעיל לחשוף את נתוניך האישיים ו/או את המידע האישי הרגיש שלך לגורמים מוסמכים מטעמנו (עובדים ו/או ספקי שירותים מורשים). גורמים מוסמכים אלה, מחויבים חוזית לעבד את המידע שלך בהתאם להנחיותינו ועל פי סטנדרטים מקובלים של אבטחת מידע ע"פ הדין הסלובני או הישראלי, לפי העניין.
במידה והנך מעוניין/ת בהפקת דו"ח מודפס, החברה תקבל גרסה דיגיטלית ייעודית לצורך העברתה לבית הדפוס איתו הנה עובדת. משמעות פעולה זו הנה חשיפת ממצאי הדו"ח לגורמים שלישיים ובכך הנתונים האישיים שלך כבר לא יהיו חסויים וחשופים רק עבורך ומשכך החברה מסירה אחריותה מכל נזק שיגרם לך עקב כך והנך פוטר את החברה מכל אחריות בגין פעולה זו והשלכותיה.
ב. בדיקות המבוצעות על ידינו ו/או ע"י גורמים מוסמכים מטעמנו מתבססות על נתונים אנונימיים בלבד. לדגימת הבדיקה מכל אחד מהלקוחות מוקצה קוד מספרי לפני תחילת תהליך האבחון, על מנת למנוע כל אפשרות לחשיפת פרטי זהות אישיים. פרטי הזיהוי האישיים שלך מקושרים לתוצאות האבחון, רק לאחר השלמת התהליך וקבלת תוצאות האבחון.
14. זכויות ביטול
א. תחת חריגים מסוימים, נתונה לך הזכות לקבל העתק של הנתונים האישיים שקיבלנו ממך ולתקן טעויות כלשהן באותם נתונים. אם ברצונך לממש זכות זו, אנא ידע/י אותנו בכתובת info@geneplanet.com. בקשתך תטופל בהקדם האפשרי ותבוצע תוך תקופה של 40 יום.
15. שיווק ישיר
א. ניתן להשתמש בפרטים האישיים שמסרת כדי להציג לך או ליידע אותך באשר למוצרים והשירותים שלנו שעשויים לעניין אותך. ניתן לבצע שיווק מסוג זה באמצעות דואר, דואר אלקטרוני, הודעת טקסט ,(SMS) טלפון או פקס. ביכולתך לבטל את ההרשאה לקבל מידע כאמור אודות המוצרים והשירותים שלנו, באמצעות הודעה לכתובת info@geneplanet.com .ו info@mybio.co.il
16. הוראות תחולת תוקף התנאים
א. תנאים כלליים אלה לביצוע אבחון גנטי ולשימוש בו תקפים מיום 26.9.18 ואילך.
ב. אנו שומרים לעצמנו את הזכות לשנות או לעדכן את התנאים הכללים וההגבלות. תנאים חדשים או מעודכנים תקפים מיום הפרסום שלהם באתר הבית שלנו. אנו לא נשלח התראה אישית על כל שנוי מעין זה כיוון שתנאים חדשים יחולו עליך, הנך מסכים לעקוב אחרי שנויים אלו באתר.
17. כללי ה- GDPR
לעיונך ונוחיותך אנו מצרפים בזאת את הצהרת GP ביחס לציות GP לכללי הגנת הפרטיות התקפים באיחוד האירופאי-

GDPR Compliance Statement
The EU General Data Protection Regulation (“GDPR”) came into force across the European Union on 25th May 2018
and brought with it the most significant changes to data protection law in two decades. Based on privacy by design
and taking a risk-based approach, the GDPR has been designed to meet the requirements of the digital age.
The 21st Century brings with it broader use of technology, new definitions of what constitutes personal data, and
a vast increase in cross-border processing. The new Regulation aims to standardize data protection laws and
processing across the EU; affording individuals stronger, more consistent rights to access and control their
personal information.
GenePlanet is committed to ensuring the security and protection of the personal information that we process, and
to provide a compliant and consistent approach to data protection. Even before GDPR, we have always had a
robust and effective data protection program in place which complies with existing law and abides by the data
protection principles. However, we recognize our obligations in updating and expanding this program to meet the
demands of the GDPR.
We are dedicated to safeguarding the personal information under our remit and in developing a data protection
a regime that is effective, fit for purpose and demonstrates an understanding of, and appreciation for the new
Regulation. Our preparation and objectives for GDPR compliance include the development and implementation
of new data protection roles, policies, procedures, controls and measures to ensure maximum and ongoing
compliance.
GenePlanet takes the privacy and security of individuals and their personal information very seriously and take
every reasonable measure and precaution to protect and secure the personal data that we process. We have
robust information security policies and procedures in place to protect personal information from unauthorized access, alteration, disclosure or destruction and have several layers of security measures.
GENERAL TERMS AND CONDITIONS FOR PERFORMING AND USE OF GENETIC ANALYSIS
1. Terms
- Analysis is performed and personal and sensitive data is controlled by the company genEplanet, personal genetics, d.o.o ("We", "us" and "our"). Please read carefully the following general terms and conditions for performing and use ("Terms") as they will shed light on the necessary founding services and allow you to discover the results and information provided by these services.
- We reserve the right to change the Terms at any time and for any reason.
- Conditions are written by following legal provisions of the Republic of Slovenia. Slovenian courts have exclusive jurisdiction over any claims or disputes arising out of or in connection with the conditions.
2. Ordering process
- You have received the kit for taking your biological sample, instructions for sample submission and instructions on where to fill your personal data which are needed for successful analysis completion.
- Please fill out in detail all the necessary information requested with your order, because otherwise we cannot accept and/or successfully process your sample.
- Collect your saliva sample and return it back to our processing centre. Be careful to follow all instructions on how to correctly collect your sample and return it to us otherwise we cannot guarantee success of your sample analysis.
3. Results of genetic analysis
- In case we will end up performing genetic testing of your DNA, we would try to send the results of the analysis to you within our SOP determined period from the date we receive your saliva sample.
- Information (with the genetic results), graphic content, text, images, trademarks, trade names and logos (the "Materials") are protected by copyright and other intellectual property laws. Once you agree to the Terms of Use, we grant you, for a period of time, a non-exclusive license for personal purposes. Personal purposes means for reading, viewing and/or printing of one available copy of the materials, as long as all copyright, trademark and other proprietary notices are left intact. Any other use of the contents of the genetic analysis, such as the reproduction, modification, distribution, transmission, re-publication, or use of content is prohibited.
- In case of a change of your personal data necessary for the delivery of our products, you must notify the company genEplanet d.o.o and/or data processor through which you ordered genetic analysis in due time. If this is not done on time, then the analysis will be sent to the address specified when ordering (if your order included printed version of analysis results) and will be considered to be received.
- After receiving the results of the genetic analysis to your premises (receipt of printed book to your premise or download of electronic results to your computer), it is you who is responsible for protecting them from being seen by anyone unauthorized.
- genEplanet d.o.o employs the latest knowledge and the highest standards to provide that all information and test results are accurate and correct, but we are not responsible for the reliability and integrity of the data. Acquired genetic material is analysed based on current scientific research and publications on Caucasian race (white European), but this data might be subject to change over time as new findings emerge.
4. Website access
- We will make the necessary arrangements to ensure that the Website is fully operational at all times. However, due to the nature of interactive services and the internet generally, we cannot guarantee that the Website will be free from delays, interruptions or errors and access to the Website may be suspended (whether by us or due to external causes) temporarily and/or without notice. We will not be liable for any loss or damage arising from the Website not being available (whether for internal processing reasons or otherwise).
- We may restrict, suspend or terminate your use of the Website if we believe that you have breached these Terms and Conditions at any time. The suspension or termination of the Website will be without prejudice to any rights which we may have against you in respect to your breach of these Terms and Conditions.
- You are responsible for ensuring that no unauthorized access is obtained into your account. 6. The rights for cancellation and refund
- You have the right to cancel the service contract according to the general cancellation terms.
- Where you have purchased a saliva collector kit, you may cancel your purchase within seven working days of receiving the saliva collector kit. You must return the saliva collector kit to us unused, complete and in a re-saleable condition on your own expense and we will return your money minus our transportation fees;
- If you have already submitted your biological sample, you can still cancel the ordered services until the sample has not been submitted for analysis in the laboratory. Upon this cancellation you will be charged with the administrative costs and the use of the kit, and the difference would be returned.
- In any case we try to guarantee that you will be satisfied with the obtained genetic analysis. In case that you are dissatisfied with the product or services that you received from us, please contact us by e-mail support.en@geneplanet.com.
- Apart from your cancellation right, where any valid claim in respect to any item or service sold by us is based on any defect in the quality or condition of the items or service or their failure to meet specification, we shall be entitled to replace the goods or service (or the part in question) free of charge or, at our sole discretion, refund the price of the items or service (or a proportionate part of the price), but we shall have no further liability to the purchaser to the fullest extent permitted by law.
7. Warranties and disclaimers
- By placing your order, you warrant that:
- You are legally capable of entering into this contract;
- You are at least 18 years of age; and
- If you are sending a saliva sample from third parties then you have the permission and authorization of that third party, and that authorization will be sent to us with saliva sample. You also need to send us copy of authorizing person’s identification card where his/her signature is visible so that we can be completely sure that authorisation is valid.
- WHILST ALL REASONABLE EFFORTS ARE MADE TO ENSURE THAT ANY INFORMATION, INCLUDING THE RESULTS, SUPPLIED BY US IS CORRECT, WE MAKE NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, IN RELATION TO THE TIMELINESS, ACCURACY OR COMPLETENESS OF SAID INFORMATION. YOU CAN NOT RELY SOLELY ON THE CONTENT OR INFORMATION RECEIVED FROM GENETIC ANALYSIS TO BASE YOUR DECISIONS ABOUT IMPORTANT PERSONAL AND MEDICAL DECISIONS ON IT. YOU SHOULD CONSULT AN APPROPRIATE PROFESSIONAL FOR ADVICE, WHICH WOULD BE SPECIFIC IN TERMS OF YOUR PARTICULAR SITUATION.
- In rare cases for specific analysed DNA loci (gene information) it is not possible to obtain unambiguous information due to biological or technical reasons. This means, that the detected signal is of so low quality, that it is not possible to claim with 100% certainty, what the result is. To ensure high quality, scientific accuracy and correctness of our analyses in such cases, we cannot interpret the results and consequently the final report can be missing some SNP information and specific analysis results. The final report will be treated as successfully completed if up to two specific analyses are missing and the analysis will not be repeated in this case.
- We make no representations, warranties or undertakings that the Website, or the server that makes it available, will be compatible with your equipment or free from defects, including but not limited to viruses or other harmful elements. We accept no liability for any infection by computer virus, bug, tampering, unauthorised access, intervention, alteration or use, fraud, theft, technical failure, error, omission, interruption, deletion, defect, delay, or any event or occurrence beyond our control, which corrupts or affects the administration, security, fairness and integrity or proper conduct of any aspect of the Website or your equipment.
- Except as expressly set out in these Terms and Conditions, all representations, warranties, terms and conditions whether express or implied in relation to this Website or the information contained therein are hereby excluded to the fullest extent permitted by law.

- When ordering the test, you are aware of the potential impacts and risks of genetic analysis and in full awareness agree that genEplanet d.o.o takes no responsibility whatsoever for consequences.
- Our products are not a substitute for medical diagnosis, treatment, doctors’ recommendations, visit or search for recommendations from other official health institutions regarding medicines, nutrition, lifestyle, treatment methods or related services. It is intended to be used for information purposes only and for drawing attention to the importance of prevention for a longer and healthier life.
9. General provisions
- We kindly ask you to carefully read the provisions of the Statement regarding genetic analysis, as you will have to confirm that you agree with them before you send us your personal information.
10. Collection and use of personal data
- Any personal information you entrust to us will be treated in accordance with the Law on the Protection of Personal Data. You have the right to have access to your personal information that we process and can request its modification, amendment, deletion or anonymization.
- Saliva sample that you send contains genetic code, which during the period of our contractual relationship is dealt as extremely sensitive and confidential personal information and in accordance with the Data Protection is regarded as health information. Analysis of sample is necessary in the process of genetic testing. We commit ourselves to the protection of the confidential nature of such data and use it only to the extent that is necessary to produce by your order required service. You acknowledge that by ordering our services you agree to the provisions of these Terms, and you give us explicit consent to process your extremely sensitive personal information. If you submit a saliva sample that belongs to another person, we need you to confirm that the other person has expressed consent to allow us to process such highly sensitive personal information.
11. Disclosure of personal data
- In accordance with the strict rules of confidentiality we may reveal your personal data and/or sensitive personal information within a reasonable extent necessary to carry out the purposes described above to our authorized personnel and/or service providers. Authorized persons and/or service providers are contractually bound to process your data in accordance with our instructions and under safety standards of the Slovenian Law on Data Protection.
- Testing done by us and on our behalf is based on anonymous data. The test sample from each client is designated with the number in code before start of the analysis to prevent any disclosure of any personal identifying information. Your identity is connected with the test results when the test results come back from our service providers.
12. Rights of withdrawal
- Under certain exceptions, you have the right to obtain a copy of the personal data that we obtained from you, and correct any irregularities in such data. If you want to cancel any of these rights, please inform us at support.en@geneplanet.com. Your request will be dealt as fast as possible, and will be done within 40-day period.
13. Direct marketing
- The personal information that you have submitted may be used, in order to present to you or inform you about our products and services that may be of interest to you. This type of marketing can be done by mail, e-mail, SMS, telephone or fax. Information on products and services can always be canceled over a message to support.en@geneplanet.com.
14. Final provisions
- These General terms and conditions for performing and use of genetic analysis are valid from 30.01.2017 onwards.
- We reserve right to change or update our General terms and conditions. New or updated terms are valid from the day they are published on our web page. We will not send you specific notification of terms change. Since new terms will also apply to you already you agree to follow our web page for terms change.
